Reinhart, OPI Enterprises, LLC T/a Swallow at the Hollow, 5921-23 York Road – Class BD7 Beer, Wine & Liquor License - Violation of Article 2B §201(a)(2) “A person may not sell, or suffer to be sold, or for the purpose of sale, transport, buy, possess, keep or suffer to be transported, bought, possessed or kept in any vehicle, vessel or aircraft or on any premises or under the person’s charge or control any alcoholic beverages except on premises licensed under this article unless otherwise provided for in this article” on May 1-7, 2012 (Re: Liquor Board Inspector observed the sale of alcohol when the 2012 license fee had not been paid)

Andre Willabus, Carlos Mason & Tanya Mason, Harrison & Mason, LLC T/a Orem Liquors, 2300 Orem Avenue - Class “A” Beer, Wine & Liquor license – Violation of Article 2B §201(a)(2) “A person may not sell, or suffer to be sold, or for the purpose of sale, transport, buy, possess, keep or suffer to be transported, bought, possessed or kept in any vehicle, vessel or aircraft or on any premises or under the person’s charge or control any alcoholic beverages except on premises licensed under this article unless otherwise provided for in this article” on May 1-4, 2012 (Re: Liquor Board Inspector was able to purchase alcoholic beverage on a date when the 2012 license fee had not been paid); Violation of Rule 3.02 “Licensees shall cooperate with representatives of the Board, members of the Police Department, Health Department, Building Engineer's office, Grand Jury and representatives of other governmental agencies whenever any such persons are on official business” on May 4, 2012 (Re: Employee did not cooperate with Liquor Board inspector)

T/a Club House Bar & Liquor, 4217 Erdman Avenue - Class BD7 Beer, Wine & Liquor license – Violation of Rule 5.03 “For purposes of this Rule, the Board considers all Class BD7 licenses as tavern operations. A tavern is defined as an establishment where alcoholic beverages are habitually sold for on-premises consumption. Such alcoholic beverages must be served at a bar or in a lounge area....(b) ...The bar/lounge area must be operative for business at all times the premises is open to the public" on May 14, 2012 (Re: Establishment not operating as a tavern, part-time inspector was denied entrance to bar); Violation of Rule 4.18 “No licensee shall commit or allow the commission on his premises of any act which shall be contrary to any federal, state or local statute, law or ordinance or against the public peace, safety, health, welfare, quiet or morals” on May 14, 2012 (Re: Licensee is selling drug paraphernalia in violation of Baltimore City Code, Article 19 §17-3); Violation of Rule 3.06 “Licensees shall operate their establishments at all times in accordance with the requirements of the Health Department of Baltimore City, the Building Code of Baltimore City, and the rules and regulations of the Fire Department of Baltimore City” on May 14, 2012 (Re: Access to hot water heater blocked by stock, back door locked, stock stacked on floor everywhere in building, electrical outlets not covered, and ceiling tiles need to be replaced)

Charles Street – Class “B” Beer, Wine & Liquor License - Violation of Rule 4.05(a) “No licensee shall permit any person to consume alcoholic beverages on the licensed premises during hours when such sales are prohibited by law” on April 1, 2012 (Re: At 2:29 am, police officer observed approximately 35 patrons in the club, several of whom were consuming alcoholic beverages); Violation of Rule 4.18 “No licensee shall commit or allow the commission on his premises of any act which shall be contrary to any federal, state or local statute, law or ordinance or against the public peace, safety, health, welfare, quiet or morals” on April 1, 2012 (Re: Police officer observed man identified as owner light a cigarette and smoke inside establishment in violation of Baltimore City Health Code §12-105);

Thomas D. Nevin Sr., Nevin’s Cross Street Station, Inc., T/a Nevin’s Cross Street Station, 31-33 E. Cross Street – Class BD7 Beer, Wine & Liquor license – Violation of Rule 4.05(a) “No licensee shall permit any person to consume alcoholic beverages on the licensed premises during hours when such sales are prohibited by law” on March 17, 2012 (Re: After 2:00 am, police officers observed approximately 27 customers on licensed premises; several individuals had alcoholic beverage drinks in their hands); Violation of Rule 3.02 “Licensees shall cooperate with representatives of the Board, members of the Police Department, Health Department, Building Engineer's office, Grand Jury and representatives of other governmental agencies whenever any such persons are on official business” on March 17, 2012 (Re: Licensee yelled and argued with police)

Gladys Fernandez, Gladys, Inc. T/a El Tequizo Cantina, 500 S. Lehigh Street – Class BD7 Beer, Wine & Liquor license – Violation of Rule 4.05(a) “No licensee shall permit any person to consume alcoholic beverages on the licensed premises during hours when such sales are prohibited by law” on May 12, 2012 (Re: After 2 am, Liquor Board Inspectors observed approximately 25 patrons on licensed premises at least 16 of whom had bottles of beer in their possession); ); Violation of Article 2B Section 11-304(d) (2) “In Baltimore City, a licensed premises shall cease all operations, including the serving of alcoholic beverages or food and providing entertainment, at the closing hour for that class of licensed premises specified in this article” on May 12, 2012 (Re: Liquor Board inspectors observed patrons playing pool after closing time for licensed premises)

Raymond W. Makarovich, Jr., Ray Junior, Inc. T/a Rosie’s Bar, 482 S. Bentalou Street – Class BD7 Beer, Wine & Liquor license – Violation of Rule 4.15 “No licensee shall allow his premises to be used for the purpose of gambling in any form” on January 11, 2012 (Re: Police officer witnessed a payoff to a customer playing a video gaming machine on the licensed premises) and on January 19, 2012 (Re: Execution of search and seizure warrant; cash, video gaming machine microprocessors, remote transmitters, video gaming machine power packs, and pay-out ledger seized)

Mehdi Poursaka & Michelle Silvers, Ultra Lounge, LLC T/a Mirage, 401 W. Baltimore Street – Class BD7 Beer, Wine & Liquor license - Violation of Rule 3.12 “Licensees shall operate their establishments in such a manner as to avoid disturbing the peace, safety, health, quiet, and general welfare of the community” on February 20, 2012 (Re: Huge crowd outside main front door blocking patrons from exiting), on March 12, 2012 (Re: Liquor Board Inspector responded for complaint and observed large crowd of patrons standing outside licensed premises) and on April 16, 2012( Re: Large crowd blocking sidewalk and street); Violation of Rule 3.06 “Licensees shall operate their establishments at all times in accordance with the requirements of the Health Department of Baltimore City, the Building Code of Baltimore City, and the rules and regulations of the Fire Department of Baltimore City” on April 16, 2012 (Re: Establishment was over capacity determined by the Fire Department and security was not maintaining an accurate count); Violation of Rule 3.02 ““Licensees shall cooperate with representatives of the Board, members of the Police Department, Health Department, Building Engineer's office, Grand Jury and representatives of other governmental agencies whenever any such persons are on official business” on April 16, 2012 (Re: After being advised not to allow additional patrons to enter, police observed security allowing patrons to enter at rear alley door of club); Violation of Rule 4.16 “No licensee shall allow his premises to be used for the purpose of possession, transfer or use of any narcotic drug” on April 16, 2012 (Re: Police detected strong odor of burning marijuana)
