Pulaski Street – Class BD7 Beer, Wine & Liquor license - Violation of Rule 3.12 "Licensees shall operate their establishments in such a manner as to avoid disturbing the peace, safety, health, quiet, and general welfare of the community" on September 16, 2012 (Re; Establishment was overcrowded and unauthorized adult entertainment was being provided on second floor where an underage patron was shot and killed); Violation of Article 2B §12-108(d) "No licensee, proprietor, or operator of any establishment dispensing alcoholic beverages shall permit the consumption or possession of any alcoholic beverages by a person under the age of twenty-one years upon said premises no matter by whom such alcoholic beverages shall have been purchased or from whom obtained…" and/or Violation of Rule 4.01(a) "No licensee shall sell or furnish alcoholic beverages to any person under twenty-one (21) years of age or to any person with the knowledge that such person is purchasing or acquiring such beverages for consumption by any person under twenty-one (21) years of age" on September 16, 2012 (Re: Sale of alcohol to 20 year old patron who was shot and killed) and on September 16, 2012 (Re: Several witness who were interviewed were under 21 and had been consuming alcoholic beverages); Violation of Rule 4.01(a) "No licensee shall sell or furnish alcoholic beverages to any person under twenty-one (21) years of age or to any person with the knowledge that such person is purchasing or acquiring such beverages for consumption by any person under twenty-one (21) years of age" on October 18, 2012 (Re: Alcohol sold to under 21 Baltimore Police Cadet); Violation of Article 2B §10-202(e)(2)(i) "On receipt of an application for a new license, a transfer of a license, a change in the class of the license, a request for live entertainment on the licensed premises, or an extension of the licensed premises, the Board of License Commissioners for Baltimore City shall advertise and post notice of the application or request in accordance with this paragraph.; (ii) The notice shall be posted on the premises described in the application.; (iii) The Board shall hold a public hearing on each request for a new license, a change in the class of license, a request of live entertainment, or an expansion of the licensed premises" on September 16, 2012 (Re: Patrons were on second floor of location and adult entertainment was being provided; second floor is not part of the licensed premises and no application has been approved for adult entertainment or use of second floor) on September 28, 2012 (RE: DJ playing music on second floor ) on October 18, 2012 (Re: Four patrons consuming alcohol on second floor ) and on November 3, 2012 (Re: Second floor being used; police observed patrons exiting second floor staircase, empty beer bottles and plastic cups with alcoholic beverages in them); Violation of Rule 4.18 "No licensee shall commit or allow the commission on his premises of any act which shall be contrary to any federal, state or local statute, law or ordinance or against the public peace, safety, health, welfare, quiet or morals" on September 16, 2012, September 28, 2012, October 18, 2012 and November 3, 2012 (Re: Licensee using second floor of location, providing adult entertainment and live entertainment without Liquor Board or Zoning Board approval); Violation of Rule 3.06 "Licensees shall operate their establishments at all times in accordance with the requirements of the Health Department of Baltimore City, the Building Code of Baltimore City, and the rules and regulations of the Fire Department of Baltimore City" on September 16, 2012 (Re: Capacity of establishment is listed as 55 but police estimate that 200 people were in establishment and on September 28, 2012 (Re: During inspection, violations of Health Department rules observed) and on October 18, 2012 (Re: Police observed steamed crabs being served and being kept warm with portable heaters without appropriate food permit); Violation of Rule 3.03(c) "Licensees shall keep on their premises records containing the legal names, aliases, addresses, ages, and Social Security numbers of all persons employed by them. Such records shall be open for inspection at all times by duly authorized representatives of the Board, the Police Department of Baltimore City, and other governmental agencies" on September 16, 2012 (Re: No employee records were available); Violation of Rule 3.02 "Licensees shall cooperate with representatives of the Board, members of the Police Department, Health Department, Building Engineer's office, Grand Jury and representatives of other governmental agencies whenever any such persons are on official business" on September 28, 2012, October 18, 2012 and November 3, 2012 (Re: Licensee and manager continued unauthorized use of second floor after repeatedly being advised to discontinue the use)
